Welcome to the AALS website and any information, data, or content contained therein (“the AALS website,” “our site” or “this site”), a website owned and operated by the Association of American Law Schools (“AALS,” “we” or “us”). The AALS website includes www.aals.org, dlt.aals.org, far.aals.org, am.aals.org, clinical.aals.org, nlt.aals.org, teach.aals.org and any other AALS webpages or services (e.g., jle.aals.org) that link back to these terms of use (“Terms”).

Acceptance of Terms of Use

These Terms govern your use of the AALS website, and by accessing our sites, and entering your information into AALS websites, you agree to the Privacy Policy and Terms of Use set forth below. If you do not accept these Terms, you should not access this site or use any of the services provided through this site.

By using our site, you also indicate your understanding that AALS may revise these Terms from time to time without providing notice to you. Your continued use of this site after we have revised the Terms will indicate that you accept them as revised. We recommend that you review these Terms regularly.

You may be asked to indicate your acceptance to these Terms when registering for an AALS Account or when using certain services. If you choose to use any of the services provided through this site, you may be asked to electronically agree to the terms customized to those services. Access to AALS websites and their content does not create a professional services relationship or any other relationship with AALS.

Access to dlt.aals.org and its contents are provided free of charge but is limited to eligible members. Demographic, academic, and employment Information is collected for the AALS’ legitimate interests and to enhance the user experience. The Directory of Law Teachers is intended solely as a reference book for organizations, institutions, or individuals that have lawfully acquired its contents. All other use is strictly prohibited without prior written authorization from the AALS. By accessing the Directory online, you agree not to copy, collect, store, disseminate, or otherwise disclose its contents to any other person.

Access to the far.aals.org site and its content is provided after registering for a fee. Its use does not create a professional services relationship or any other relationship with AALS. AALS makes the FAR available to paid users only on the express condition that the information contained in it is used solely for the purpose of evaluating candidates for possible faculty recruitment and not for any other purpose. FAR information or data should not be used for research, converted into any database, or shared with any person not directly involved in the school’s faculty recruitment process.

Permitted Use and Access

The AALS grants you a personal, non-exclusive, non-transferrable, limited privilege to access our site. Your access to our site is limited solely to the forward-facing portions of the site. Unauthorized access includes, but is not limited to, attempts to gain access to any portion or feature of the site, or any other systems or networks connected to the site, or associated server(s), or to any of the services offered on or through the site, by hacking, password mining, application of scripts or other electronic mechanisms, or any other illegitimate means. Your access to the site is governed by all applicable laws.

Further, you may not engage in any activities that could damage, disable, or impair any AALS server; disrupt the normal flow of dialogue by the site in a manner that negatively affects other users’ ability to use the site; collect content or information or otherwise mirror or access our site using automated means (such as harvesting bots, robots, spiders, or scrapers); or modify, copy, distribute, or make any attempt to discover the source code, algorithms, or processes of this site.

Your Security Obligations Regarding Your Account and Use of This Site

If you register with our site, you agree to provide us with current, complete and accurate information as requested by the applicable registration form. You are entirely responsible for maintaining the confidentiality of your account and are wholly responsible for any and all activities that occur under your account. AALS may provide links to other websites that are not owned or controlled by AALS. Opinions and other statements expressed by users and third parties are theirs alone, not opinions of AALS. Content created by third parties is the sole responsibility of the third parties and its accuracy and completeness are not endorsed or guaranteed. The Sites and third parties may provide links to web pages, websites, and various resources or locations on the web. AALS has no control over the information you access via such links, does not endorse that information, and is not responsible for it or for the consequences of your use of that information.

No Warranty and Limitation of Liability

AALS has worked to ensure the accuracy of the information it provides through its products and services, including through the Sites. This information frequently relies on data obtained from many sources, however, and AALS cannot guarantee the accuracy of the information provided or any analysis based thereon. You expressly agree that the use of AALS’s products and services, including the sites, is at your sole risk. Such products and services are provided on an “as is” basis and AALS makes no warranties, expressed or implied, and disclaims any implied warranties of merchantability, fitness for a particular purpose and non-infringement. AALS disclaims any warranty that the service will be uninterrupted, secure or error free. No advice, opinion or other information obtained through the sites or from AALS, orally or in any media, shall create any warranty from AALS not expressly stated in this agreement. Except as otherwise stated, AALS makes no warranty or representation regarding of confidentiality of any communication or information transmitted on these sites or any web sites linked to the sites. You agree that neither AALS, nor any other providers of products or services related to the sites, are responsible for the confidentiality of any information, (including without limitation credit card information, personally identifiable information, including email address, phone number, etc.), and neither AALS nor any other providers of products or services related to the sites are responsible for any damages that may arise from disclosure of such information. AALS and its representatives shall not be liable under any circumstances for any direct, indirect, consequential, special, exemplary, punitive or other damages, including lost profits or costs or attorney’s fees, under any legal theory including but not limited to breach of contract, breach of warranty, negligence, or strict liability, regardless of whether AALS was informed of the possibility of such damages. AALS owns all rights to our trademarks – including, but not limited to, AALS, Association of American Law Schools, AALSNews, Becoming a Law Teacher, Directory of Law Teachers, Faculty Appointment Register, Journal of Legal Education– and related logos used in connection with our association and services.

Nothing in these Terms grants you any right to use any trademark, service mark, logo or trade name of ours or any third party.  AALS logos may not be used without prior written permission of the AALS.

All other logos and trademarks appearing on the site are the property of their respective owners.

Permission Grant and Copyright Notice

Unless otherwise indicated on the specific webpage and/or document and/or form, the AALS grants permission to reproduce and distribute documents and related images available the AALS website, provided that:

Use of documents and related images available from this site is for educational and non-commercial purposes only, including professional conferences; The copyright and permission notices appear in all reproductions; No documents or related images available from this site are modified in any way; and No graphic images or data tables available from this site are used, copied or distributed separate from accompanying text.

Indemnification

Special Agreement on Fee-Shifting and Choice of Law

If you attempt to bring any legal action against AALS based in any way on its products or services, including the Sites, you agree that, in the event you do not prevail or AALS does prevail, you will reimburse AALS for any costs and attorneys’ fees associated with their defense of the action. The use of the Site and any claim or dispute relating to the Sites shall be governed by the laws of the District of Columbia, without regard to its conflicts of law principles. Exclusive venue for any claim shall be in the district, state and federal courts located in the District of Columbia. Use of the Sites is unauthorized in any jurisdiction that does not affect all provisions of these Terms of Use, including without limitation this paragraph.

Severability

If any provision or portion of these Terms of Use is held in whole or in part to be unenforceable for any reason, the remainder of that provision and of the entire agreement will be severable and will remain in effect, to the fullest degree consistent with the intent of this document.
